Terms of Service

1. Agreement & Parties

This Licensed Application End User License Agreement (“Custom EULA” or “Terms”) is a binding agreement concluded between you (the “End-User”) and HiCalculator Developer Team (“Licensor”, “we”, “us”, or “our”) only, and NOT with the application store platform provider (such as Apple Inc. or Google LLC) from which you downloaded the application. Licensor, not the application store provider, is solely responsible for HiCalculator (the “Licensed Application”) and the content thereof.

This EULA does not provide for usage rules for HiCalculator that are in conflict with the applicable store terms of service as of the Effective Date.

2. Scope of License

Licensor grants to the End-User a limited, non-transferable, non-exclusive license to use HiCalculator on any compatible mobile or desktop devices that the End-User owns or controls as permitted by the Usage Rules set forth in the applicable application store terms of service.

Subscriptions, in-app purchases, and vault access within HiCalculator are non-transferable and associated exclusively with the individual purchaser's store account. Except as expressly allowed by law or these Terms, you may not distribute, lease, sell, sublicense, reverse-engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works of HiCalculator or any part thereof.

3. Maintenance and Support

Licensor is solely responsible for providing any maintenance and support services with respect to HiCalculator, as specified in this EULA or as required under applicable law.

You and Licensor acknowledge that the application store platform provider has no obligation whatsoever to furnish any maintenance and support services with respect to HiCalculator.

4. Warranty & Store Refunds

Licensor is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed herein.

In the event of any failure of HiCalculator to conform to any applicable warranty, you may notify the applicable application store provider, and the application store provider will refund the purchase price for HiCalculator to the End-User in accordance with its refund policies. Refund eligibility is determined solely by the applicable application store provider in accordance with its policies. To the maximum extent permitted by applicable law, the application store provider will have no other warranty obligation whatsoever with respect to HiCalculator.

5. Product Claims & Liability

You and Licensor acknowledge that Licensor, not the application store provider, is responsible for addressing any claims of the End-User or any third party relating to HiCalculator or the End-User’s possession and/or use of HiCalculator, including product liability, legal compliance, and privacy claims.

This EULA does not limit Licensor’s liability to the End-User beyond what is permitted by applicable law.

6. Intellectual Property Rights

You and Licensor acknowledge that, in the event of any third-party claim that HiCalculator or the End-User’s possession and use of HiCalculator infringes that third party’s intellectual property rights, Licensor, not the application store provider, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

7. Legal Compliance & Export Control

The End-User must represent and warrant that:

• (i) He/she is not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and
• (ii) He/she is not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-Party Terms of Agreement

You must comply with all applicable third-party terms of agreement when using HiCalculator (such as wireless carrier terms or internet provider terms).

10. Third-Party Beneficiary Terms

You and Licensor acknowledge and agree that the applicable application store platform provider (including Apple Inc. and its subsidiaries for iOS downloads) and its affiliates are third-party beneficiaries of this EULA, and upon your acceptance, the application store provider will have the right to enforce this EULA against you as a third-party beneficiary thereof.

11. Vault Security, Zero-Knowledge Encryption & Passcodes

HiCalculator provides calculator functionality together with an optional encrypted private vault for securely storing personal files. Local vault databases and backups utilize zero-knowledge on-device encryption. Encryption keys and security PINs are derived locally on your device.

Zero-Knowledge Architecture & Forgotten Credentials: Because your vault is encrypted locally, Licensor does not hold a master key, recovery backdoor, or copy of your PIN, passcode, fake passcode, or backup password. Licensor support cannot unlock, decrypt, reset, recover, or reconstruct your vault or backup files if credentials are lost or forgotten.

User Backup Responsibility: You are solely responsible for protecting your device access, maintaining secure passcodes, and keeping verified unencrypted backups if needed. Licensor is not responsible or liable for any data loss resulting from device damage, app deletion, OS updates, forgotten passcodes, or corrupted hardware.

12. Subscriptions, Trials, Purchases & Store Billing

Certain premium features (“HiCalculator Pro”) are available through one-time purchases or auto-renewable subscriptions (which may include promotional free trial periods or special offers where applicable). Specific pricing, subscription terms, billing intervals, and trial durations (if offered) are clearly displayed in the store purchase confirmation dialog prior to transaction completion.

Payment will be charged to your Apple Account (or applicable store account) at confirmation of purchase. Subscriptions renew automatically unless canceled in your account settings at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

To request a refund, please use the refund channels provided by your store provider (such as Apple’s Report a Problem service or Google Play refund options). Refund eligibility is determined solely by the applicable application store provider in accordance with its policies.
